Bankruptcy- Dealing With Exempted Property After Divorce
Today there are almost a million people going to court to file a financial distress petition. Though many people believe that this happens to people with irresponsible spending habits, there are other reasons that are beyond an individual control, that may leave him with no option but to file a bankruptcy petition. Soaring medical bills, loss of jobs or recession in the economy are situations that cause people to file for financial distress petition.
Going to court may be done involuntarily by the creditors on behalf of the debtor or voluntarily by the debtors themselves. Whichever way, the debtor must understand the effects that the financial crisis has in their lives. In cases where bankruptcy may lead to divorce, it is important for both parties to understand the effects that this will have on them. Though the court may order an automatic stay, this may not mean that a spouse cannot ask for divorce.
It only means that the exempted property cannot be sold in order to recover from debt. The exempted asset can be divided between the partners/ former partners. It is also important that the parties involved realize that, it would be more appropriate to go through the bankruptcy before they can discuss the property settlement in divorce. This is because the court will have to discharge part of the assets.
In case the property settlement is done before the financial distress case has been dealt with, the person who filed the petition will not have the debts wiped out in such circumstances. In case the financial crisis might bring about divorce, the parties involved should be wise enough to deal with the financial crisis first before they can seek legal action on divorce.
